Terms of Service

1. Who we are and what these terms cover

Loudpage ([yourdomain.com]) is operated by [LEGAL BUSINESS NAME], [ENTITY TYPE, e.g. a private limited company incorporated in India] ([CIN / REGISTRATION NUMBER, or remove]), with its address at [REGISTERED ADDRESS, CITY, STATE, PIN CODE, INDIA] ("we", "us", "our").

These Terms of Service ("Terms") apply when you use our website, the studio, and any video, script, voiceover, music or other file we produce for you (together, the "Service"). Our Privacy Policy, Refund Policy and Acceptable Use Policy are part of these Terms.

By creating an account, starting a preview or making a purchase, you agree to these Terms. If you use the Service on behalf of a company or client, you confirm you are authorised to accept these Terms for them, and "you" includes that organisation.

2. Orders are handled by Paddle, our reseller

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

When you buy credits or a subscription, you buy it from Paddle, which then provides it to you under its own Buyer Terms. Paddle collects your payment details, charges any sales tax, VAT or GST that applies where you live, issues your receipt and invoice, and processes refunds. We never see or store your full card details.

3. Your account

You must be at least 18 years old and able to form a binding contract to use the Service.

You sign in with Google or a one-time email code. Keep access to that email account secure; you are responsible for activity under your account. Tell us promptly at [support@yourdomain.com] if you think someone else has used it.

Each person may have one free preview. Creating extra accounts, using disposable email addresses or otherwise working around this limit is not allowed, and we may suspend accounts that do.

4. How the Service works

You give us the address of a public website. We read its public pages and brand (colours, fonts, logo), write a script from what the site says, record a synthetic voiceover, design animated scenes and add music. Much of this work is done by automated systems, including artificial intelligence models provided by third parties.

The free preview is watermarked and for evaluation only. Paying with credits gives you the download files for that video with no watermark, end-card credit or other Loudpage branding, on every paid plan.

Before you download, we ask you to confirm each fact, number or quote the script takes from your site, and that you have permission to make a video from it. You are responsible for reviewing the video before you publish it. Automated output can contain mistakes, misread a page, or mispronounce a name, and a preview may look slightly different from the final render.

Voices in our videos are synthetic. They are not recordings of real people, and you must not present them as a real person's endorsement.

5. Plans, credits and prices

We offer these plans. Current prices are always shown on our pricing page and at checkout, in US dollars, before tax.

How credits work. One credit makes one downloadable video in the Clean, Energetic or Editorial style. The Cinematic style uses 2 credits. Credits are used only when you download a video, or when you choose to upgrade a video to Cinematic, which uses its credits when the Cinematic build starts. Re-rendering a video you already paid for after edits does not use credits, within the re-export allowance of your plan.

Plan allowances such as AI edits and re-exports per video are listed on the pricing page and in the studio. We may change prices or plans for the future. A change in the price of your subscription takes effect from your next billing month after we give you at least 30 days' notice by email; it never changes the price of credits you already bought.

6. Subscriptions, renewal and cancellation

Pro and Agency are monthly subscriptions. They renew automatically each month, and Paddle charges your payment method, until you cancel.

You can cancel at any time using the link in any Paddle receipt email, or by writing to [support@yourdomain.com]. Cancellation takes effect at the end of the current billing month; you keep that month's credits and features until then, and you will not be charged again. Videos you have already downloaded remain yours.

If a renewal payment fails, Paddle may retry it. We may pause plan features until payment succeeds.

7. Refunds

Refunds are covered by our Refund Policy and are processed by Paddle. Nothing in these Terms limits any right to a refund you have under the consumer law of the country you live in.

8. Your content and your permissions

"Your Content" means the website address you submit and anything you give us: text you type, facts you confirm, pronunciations, music you upload, and changes you ask for.

You confirm that you own the website you submit or have permission from its owner to make a video from it, and that Your Content, and our use of it to provide the Service, does not infringe anyone's rights or break any law. You are responsible for the claims your video makes.

You give us a non-exclusive, worldwide licence to access, copy, process and store Your Content, including sending it to the service providers listed in our Privacy Policy, only as needed to provide, secure and support the Service for you. This licence ends when your content is deleted, except for copies we must keep by law or in routine backups for a limited time.

We do not use Your Content or your videos to train artificial intelligence models, and we do not use your videos in our own marketing without your permission.

If you upload a music track, you confirm you have the rights to use it in your video.

9. Who owns the video

Once you have paid for a video with credits, you own the downloaded video files, subject to the rights of others in Your Content (for example your own brand, or a track you uploaded). You may use them for any lawful purpose, including commercial use, with no further fees to us.

Some parts of a video are ours or our licensors': our software, templates, motion design system, and music we generate. We grant you a perpetual, worldwide, royalty-free, non-exclusive licence to use those parts as part of the video you downloaded. You may not extract them to use separately, for example selling our generated music as a standalone track.

Free previews, and share links to them, are watermarked and may be viewed and shared for evaluation, but not published as finished marketing material.

Paid videos, on any plan, carry no watermark and no Loudpage branding, and you do not need to credit us when you use them. When you share a paid video with our share link or embed code, it plays without a watermark too.

We keep all rights in the Service itself, including our website, software, designs and brand. Feedback you send us may be used freely to improve the Service.

10. Acceptable use

You must follow our Acceptable Use Policy. In short: do not submit websites you are not entitled to use, do not use the Service to impersonate or mislead, do not break the law, and do not try to abuse, overload, reverse engineer or get around the limits of the Service. We may refuse, remove or stop any project that breaks these rules.

11. Availability and changes to the Service

We work to keep the Service running and reliable, but it may sometimes be unavailable for maintenance, updates, or reasons outside our control, such as failures at our hosting or AI providers. We may change, add or remove features. If a change materially reduces what you paid for in a current billing month, you may ask for a refund for that month.

12. Suspension and closing your account

You can stop using the Service at any time and ask us to delete your account at [privacy@yourdomain.com]. Any active subscription should be cancelled first so you are not charged again.

We may suspend or close your account if you seriously or repeatedly break these Terms, if required by law, or to protect the Service or others. Where reasonable we will tell you first and give you a chance to fix the problem. If we close your account without cause, we will refund unused purchased credits.

13. Disclaimers

Apart from the promises we make in these Terms, the Service is provided "as is" and "as available". To the extent the law allows, we do not give other warranties, including that the Service will be uninterrupted or error-free, that automated output will be accurate or complete, or that a video will achieve a particular business result.

14. Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential losses, or for loss of profits, revenue, business, goodwill or data arising from your use of the Service.

To the extent the law allows, our total liability to you for all claims relating to the Service is limited to the greater of (a) the amount you paid for the Service in the 12 months before the claim arose and (b) US$100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for fraud, or for death or personal injury caused by negligence, or your statutory rights as a consumer.

15. Indemnity

If you use the Service for a business, you agree to cover our reasonable losses and costs arising from a third-party claim that Your Content, or a video you published, infringes that party's rights or breaks the law, except where the claim is caused by our own fault.

16. Governing law and disputes

These Terms are governed by the laws of India. The courts at [CITY, STATE] have exclusive jurisdiction over disputes, except that if you are a consumer you may also bring proceedings in the courts where you live, and you keep the protection of any mandatory consumer law of your country.

17. Changes to these Terms

We may update these Terms as the Service changes or the law requires. We will post the new version here with a new effective date and, for material changes, email account holders at least 14 days before they take effect. If you keep using the Service after that, the new Terms apply. If you do not agree, you can cancel and close your account.
